Jennifer Pagonis: People often raise this and say 'why don't you bring them to arbitration,' but it's not really the right instrument to do it. For example, if the American government is not happy with the way Chinese view North Koreans, they view them obviously as illegal migrants, then that country wants to make an issue of it, then they can indeed take it to the International Court of Justice.
