틸러슨 장관은 30일 상원 외교관계위원회 청문회에서 의회 승인 여부는 모든 상황에 달려있다며, 정확한 근거에 따라 결정을 내려야 할 사안이라고 답했습니다. 대통령이 의회의 승인 없이 (전쟁 수행) 권리를 행사할 것인가는 즉각적 위협인지 여부 등 위협의 성격에 달린 문제라는 설명입니다.

매티스 장관은 헌법 2조에 따라 대통령은 국가를 보호해야 할 책임이 있다며, 시간이 촉박한 상황에서는 의회와 상의하지 않거나 혹은 지난 4월 시리아 공군기지에 대한 공습 때처럼 먼저 행동을 취한 뒤 의회에 즉시 통보하는 상황을 상상해볼 수 있다고 밝혔습니다.

[녹취: 매티스 장관] “I believe under Article II, he has a responsibility obviously to protect the country and if there was not time, I could imagine him not consulting or consulting as he’s doing something along the lines of for example of what we did at Shayrat air field in Syria where we struck that and Congress was notified immediately…but in this case of North Korea, it would be a direct imminent or actual attack on the United States I think Article II would apply.”
